Please read these terms carefully before using our website or entering into a purchase agreement
Important: By using the Property Point website, submitting an inquiry, or signing a Sale Agreement with Property Point, you agree to be bound by these Terms of Service. If you do not agree, please do not use this website or our services.
1. About Property Point
Property Point is a real estate marketing and sales platform registered in Zimbabwe. We market and sell residential and mixed-use stands on behalf of property developers. Our current portfolio includes Malinga Rise (Filabusi, Insiza District, Matabeleland South) and Masuwe (Victoria Falls).
Property Point acts as a marketing and sales agent. Ownership of land and title deeds vests in the buyer upon full payment and completion of the Deeds Office registration process.
2. Use of This Website
You may use this website for lawful purposes only. You agree not to:
- Submit false, misleading, or fraudulent information through our inquiry forms
- Attempt to gain unauthorised access to any part of the website or its servers
- Use automated bots, scrapers, or crawlers without our prior written consent
- Reproduce, republish, or redistribute any content from this website without permission
- Impersonate Property Point or any of its representatives
We reserve the right to block access to any user who violates these terms without notice.
3. Property Information & Availability
All property details, stand sizes, pricing, and availability displayed on this website are for general information purposes. Whilst we strive to keep information accurate and current:
- Stand availability changes frequently and is confirmed only at time of reservation
- Prices displayed are indicative starting prices and may vary by stand, zone, or date of purchase
- Images, renders, and maps on this website are illustrative and may not reflect the exact final state of a development
- Infrastructure timelines (servicing, tarred roads, water, electricity) are estimates and subject to change
Submitting a website inquiry does not constitute a reservation or guarantee of availability. A stand is only reserved upon receipt of a deposit and signing of a Sale Agreement.
4. Reservations & Sale Agreements
4.1 Reservation
A stand is provisionally reserved upon payment of the agreed deposit (a minimum of 30% of the purchase price). The deposit is non-refundable if the buyer withdraws after signing the Sale Agreement, unless otherwise agreed in writing.
4.2 Sale Agreement
All stand purchases are governed by a written Sale Agreement signed by both parties. In the event of any conflict between these website Terms and the Sale Agreement, the Sale Agreement prevails.
4.3 Payment Plans
Flexible payment plans are available. Failure to meet payment milestones may result in forfeiture of the reservation at Property Point's discretion, after reasonable notice to the buyer.
4.4 Accepted Payment Methods
- USD Cash
- Bank Transfer (RTGS or USD nostro)
- EcoCash (as agreed per transaction)
Always request a receipt and verify payments directly with our office before assuming a transaction is complete.
5. Title Deeds & Legal Process
- Stands are surveyed and approved by the Surveyor General (SG) of Zimbabwe
- The development is approved by the relevant local authority (Insiza Rural District Council for Malinga Rise)
- Upon full payment, a title deed is processed and registered in the buyer's name at the Zimbabwe Deeds Office
- Processing time for title deeds is subject to the pace of the Deeds Office and is outside Property Point's direct control
Buyers are encouraged to seek independent legal advice before signing any Sale Agreement.
6. Inquiries & Communications
- You consent to being contacted by our team via phone, WhatsApp, or email in response to your inquiry
- Response times quoted on the website are targets, not guarantees, and may vary outside business hours
- Any pricing or availability information provided verbally or via WhatsApp is indicative only until confirmed in a signed Sale Agreement
7. Site Visits
Property Point is not liable for travel costs, injury, accident, or loss of personal property during a site visit. Visitors must follow all safety instructions given by our staff.
8. Intellectual Property
All content on this website — including text, photographs, logos, graphics, layout, and code — is the property of Property Point or its content suppliers and is protected under Zimbabwean and international copyright law. You may not reproduce or commercially exploit any part of this website without our express written consent.
9. Limitation of Liability
- Property Point's website is provided "as is" without warranties of any kind
- We are not liable for any loss arising from reliance on information published on this website without independent verification
- Our total liability to any individual shall not exceed the amount (if any) paid by that individual to Property Point
10. Third-Party Links
This website contains links to third-party platforms including WhatsApp (Meta) and Google Maps. Property Point does not endorse or accept responsibility for the content or practices of any third-party platform.
11. Governing Law
These Terms of Service are governed by the laws of the Republic of Zimbabwe. Any disputes shall be subject to the jurisdiction of the Zimbabwean courts, with arbitration as the preferred first step in dispute resolution.
12. Changes to These Terms
Property Point reserves the right to update these Terms at any time. Continued use of the website after any changes constitutes your acceptance of the revised Terms.
